Rightfast.com is an Internet Service Provider offering storage and transfer of documents, electronic mail and other information over the Internet.

The parties acknowledge that the Internet is neither owned nor controlled by any one entity; therefore, Rightfast.com can make no guarantee that any given party shall be able to access the server made available by Rightfast.com at any given time. Rightfast.com represents that it shall make every good faith effort to ensure that their servers are available as widely as possible and with as little service interruption as possible.

1. DURATION

The term hosting plans is for 12-months and shall automatically renew thereafter unless either party notifies the other in writing at least one (1) Month prior to the end of the current term, of their intention not to renew this Agreement. Renewal prices are subject to change. Renewal of services by Client indicates agreement to any Contract revisions and price changes. Renewal fees for the following term will be automatically invoiced to your account.

2. SERVICE START DATE

The first payment plus setup charges, if any, shall be due in advance of any service provided. Service shall begin upon Rightfast.com receipt of payment for first Term of service or upon a mutually agreed upon other date.

3. TERMINATION

The Customer may terminate any Agreement by giving Rightfast.com at least thirty (30) days written notice prior to the end of the Agreement Term when the Customer desires Services to cease. If the Customer decided to terminate the Agreement before the contract term, all amounts due from the account to which the Agreement relates must be paid in order for the Customer to terminate an Agreement. No refunds will be issued in cases of early termination. Rightfast.com may terminate any Agreement by giving at least ninety (90) days prior written notice of the date of termination of Services.

4. FAILURE TO PAY

In the case of a web service hosted on a Rightfast.com hosting server, failure of Customer to remit payment to Rightfast.com by the invoice due date is cause for removal of the Client's web site files from the Rightfast.com hosting server. Customer agrees that Rightfast.com Inc. shall not be held liable for such removal or disconnection. Five (5) business days notice will be given in such cases.

Late Payment Fee: A late payment fee is applied from the bill date when payment has not been received by Rightfast.com within 10 days of the bill date, 2% monthly (26.8% per annum)

NSF cheque charge: An amount will be charged each time a cheque is returned from a bank or other financial establishment due to insufficient funds.

Re-connection Fee: In cases where service requires to be re-established due to a “failure to pay” suspension, a fee of $80.00 applies. In addition all future payments must be secured by a valid credit card (Visa / MasterCard) or advance payment.

5. LIMITATION OF LIABILITY

Rightfast.com Inc. shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from servers going off-line or being unavailable for any reason whatsoever. Further, Rightfast.com Inc. shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Rightfast.com Inc. servers. All damages shall be limited to the immediate termination of service.

6. TRADEMARKS AND COPYRIGHTS

Client warrants that it has the right to use any applicable trademarks or copyrighted material used in connection with this service.

7. DOMAIN NAME OWNERSHIP, DISPUTES, AND USE

Any domain name registered by Rightfast.com on behalf of Customer is the property of said Customer after the Customer has paid Rightfast.com any registration fees that Rightfast.com has incurred on behalf of the customer. Rightfast.com claims no ownership over Customer's domain names that the Customer has paid to register. At its option, Rightfast.com will either arrange for any billing for names registered by Rightfast.com on behalf of Customer to be sent directly by the registrar or agent thereof to the Customer, or Rightfast.com will directly bill the customer for these registration fees plus applicable expenses, and/or service charges, if any.

Customer agrees that Rightfast.com may be presented with information that Customer's domain name possibly violates the trademark rights or other intellectual property rights of a trademark or other intellectual property rights owner. In case of such action, Customer agrees to hold Rightfast.com harmless of any action taken by such owner regardless of the outcome of such dispute.

8. TAXES
Rightfast.com shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made from RightFast.com servers. Customer agrees to take full responsibility for all taxes and fees of any nature associated with such products sold.

This Agreement and Rightfast.com Inc.'s Acceptable Use Policy (A.U.P.) and Privacy Policy constitute the entire understanding of the parties. Any changes or modifications to this Agreement are agreed to by the parties upon renewal of services.
